Eastman Files Reply Brief on California Tax Hike

Dr. John C. Eastman and Anthony Caso, representing the Claremont Institute's Center for Constitutional Jurisprudence, filed a lawsuit against the State of California for unconstitutional raising of taxes in violation of the California Constitution. Proposition 13, put in place 30 years ago by the people of California, requires a two-thirds vote of the Legislature before taxes can be raised. The California Legislature in December attempted to pass legislation raising taxes by mere majority vote. Although the Legislature has finally approved another budget bill with the required two-thirds vote, the lawsuit challenging the intitial illegal vote remains pending before the California Supreme Court.
