The Claremont Institute Files Amicus Brief Defending Parental Rights and Tennessee’s Law Protecting Children from Irreversible Medical Procedures
Washington, D.C.—The Claremont Institute’s Center for Constitutional Jurisprudence, led by Dr. John Eastman, submitted an amicus curiae brief to the Supreme Court in defense of Tennessee’s law protecting children from irreversible “gender transition” medical procedures. This law stands as a bulwark against ideological agendas that seek to undermine parental rights and the well-being of our children.
Claremont’s brief emphasizes a fundamental truth: parents have a natural and constitutional right to direct the care and upbringing of their children. This right is deeply rooted in the natural law, the history and traditions of our nation, and anchored in the Privileges or Immunities Clause of the Fourteenth Amendment. The right of parents is not, however, absolute. They have no right to abuse their children, for example, and the state has a responsibility to protect children, as Tennessee has done in this case, from an egregious form of abuse–sterilization and permanent mutilation.
